Islam in Europe > Darmanin takes new French Immigration Law out for test drive; Shamima Begum's Citizenship refused again

Tunisian imam expelled from France

vows to appeal decision

A Tunisian imam expelled from France for alleged hate speech said on Friday he would take legal action in a bid to overturn the decision.

Mahjoub Mahjoubi, from the town of Bagnols-sur-Ceze in the south of France, denounced his removal as "arbitrary".

The cleric's decision came a day he was expelled from France for "radicalism" and "unacceptable remarks", French Interior Minister GĂ©rald Darmanin said in a statement posted on X on Thursday.

"The radical Imam Mahjoub Mahjoubi has just been expelled from the national territory, less than 12 hours after his arrest. We will not let people get away with anything," said Darmanin.

The 52-year-old was arrested and then deported to Tunisia on Thursday, where he arrived shortly before midnight aboard a flight from Paris.

Mahjoubi had been in France since the 1980s and is married with five children.

While all of his children are French citizens, Mahjoubi had a residency permit in France. His permit has been cancelled by Darmanin.

'Retrograde, intolerant and violent'

The official order for Mahjoubi's expulsion, seen by AFP, said that in sermons in February he had given a "retrograde, intolerant and violent" image of Islam that would encourage behaviour against French values, discrimination against women, "tensions with the Jewish community" and "jihadist radicalisation".

The imam also referred to "the Jewish people as the enemy", according to the order, which said Mahjoubi called for "the destruction of Western society".

The imam was also accused of sharing a video in which he described the "tricolour" – without specifying if he meant the French flag – as "satanic" and of "no value with Allah".

Mahjoubi defending himself, saying it had been a "slip of the tongue" and that he was referring to rivalries between football supporters of different Maghrebi nations during the recent African Cup of Nations.

"I will fight to return to France where I have lived for 40 years," the imam told AFP in his in-laws' house in Soliman, 30 kilometres (19 miles) east of Tunis.

Mahjoubi, who runs a construction company, said his family, including his youngest child who is in hospital for cancer treatment, depended entirely on him.

"My lawyer is going to take legal action in France if the court does not grant me justice, I will appeal, and then I will appeal to the European Court" of Human Rights, he added.

"I did not insult the Jewish community, nor the flag of France," he said.

'A buzz' around France's new immigration law

In another post on X on Thursday, Darmanin said  the expulsion was a "demonstration" that a recently approved immigration law "makes France stronger".

The law toughening migration conditions was seen as part of the government's response to the rise of the far-right in French opinion polls.

"Firmness is the rule," said Darmanin, who slammed what he called a "radical imam who made unacceptable comments".

Mahjoubi denounced the expulsion as being based on "an arbitrary decision", and said Darmanin was using his case to "create a buzz around the immigration law".

British court declines to restore citizenship

Feb. 23 (UPI) -- Shamima Begum, a British woman who traveled to Syria to join the Islamic State as a teenager nine years ago, lost an appeal to regain her citizenship after a unanimous decision by an appeals court.

The court's three judges ruled unanimously against granting the appeal, dismissing all five of the grounds for appeal presented by attorneys for Begum, now 24.

"It could be argued that the decision in Miss Begum's case was too harsh," Judge Sue Carr said. "It could also be argued that Miss Begum is the author of her own misfortune. But it is not for this court to agree or disagree with either point of view."

Appeals judges in London said they were left to judge whether citizenship revocation was legal and not to relitigate the case.

Carr said then-Home Secretary Sajid Javid's decision to revoke her citizenship after she left for Syria at the age of 15 was lawful as she held Bangladeshi citizenship when he made the ruling in 2019, rejecting her lawyer's argument that the decision left her stateless.

The judges also ruled that Javid was within his power to dismiss concerns that she was a victim of child trafficking and that the removal of her citizenship didn't violate equality laws on the grounds that British Muslims disproportionately face the threat of losing citizenship, citing exceptions for national security threats.

Attorney James Eadie, representing the Home Office, said that Begum's national security risk cannot be excused because she was a teenager when she left Britain for Syria.

"The fact that someone is radicalized and may have been manipulated is not inconsistent with the assessment that they pose a national security threat," he said.

Begum's supporters claim she was a trafficking victim of the Islamic State at 15 while opponents say she left to join the militant group in Syria of her own free will and is now a security risk.

Daniel Furner, Begum's attorney said he plans to keep fighting for Begum's return to Britain, hinting that he may appeal the decision to the country's High Court.

"[I'm] not going to stop fighting until she does get justice and until she is safely back home," Furner said.

"Safely" is an odd word to use here!

Begum was permitted to return to Britain in 2020 to fight for her citizenship after she had been held in a detention camp run by the Syrian Democratic forces after marrying a militant fighter and giving birth to three children, all of whom have since died.

We suffer the consequences of the decisions we make. When we make really bad decisions, we suffer really bad consequences.

Search this blog for Shamima or Begum for more tragic stories on this woman.

B.C. teacher granted full parole after strangling pregnant wife

and burning her body in 2006

By Isaac Lamoureux -October 22, 2023

Authorities have given full parole to an ex-high school teacher from British Columbia who strangled his pregnant wife to death, killing their unborn child and subsequently burning her body.

Mukhtiar Singh Panghali
, a 51-year-old former Surrey, B.C. high school teacher was granted full parole by the Parole Board of Canada after being sentenced to life for the 2006 murder of his pregnant wife, Manjit Kaur Panghali. The incident occurred in their Surrey home, and her charred remains were later found on a beach near Roberts Bank in Delta, B.C.

After killing Manjit, who was four months pregnant, Panghali made a distressing and tearful public appeal seeking assistance in finding his then “missing” wife. The murder was executed while their young daughter was left unattended at home.

Panghali was initially arrested and charged with second-degree murder in 2007. He was convicted and sentenced to life in prison in 2011 with no possibility of parole for 15 years. He lost an appeal on his life sentence for second-degree murder in 2012. He was then eventually granted day parole in July 2022, after which he secured full-time employment with an undisclosed company, according to the Parole Board of Canada.

Angela Marie MacDougall, the executive director of Vancouver’s Battered Women’s Support Services, voiced her concerns about the parole decision.

“This tells us everything we need to know about how ineffective the criminal legal system is in meeting any kind of justice for victims of intimate partner and domestic violence,” she told Global News.

Even though the Parole Board found that Panghali had “accepted responsibility for (his) actions and choices.”

“You are assessed as a high risk of violence towards a partner,” stated the Parole Board’s release decision issued on October 6th.

“Should you involve yourself in a relationship, this would be the high-risk situation for you and must be monitored closely by your (case management team) through the relevant special condition to restrict you from initiating relationships with women without the permission of your parole supervisor.”

Several conditions have been imposed on Panghali’s parole, including abstaining from alcohol, participating in a domestic violence treatment plan, and reporting any relationships with women. He is also prohibited from contacting the victim’s family, including his own daughter, who is now being cared for by Manjit’s sister.

Judges in both Canada and Australia have fixed their attention on the rights of criminals and seem to completely disregard the rights of Canadians and Australians to live in relative peace and safety. Major changes are needed in the justice systems of both countries otherwise "Justice System" is just a joke, a bad joke.

Convicted terrorist Abdul Nacer Benbrika wins high-court bid

to restore his Australian citizenship

by Dominic Giannini, AAP, October 31, 2023:

The Australian citizenship of convicted terrorist Abdul Nacer Benbrika has been restored by the nation’s highest court.

The High Court ruled on Wednesday that the Home Affairs Minister’s move to strip Algerian-born Benbrika of his citizenship was against the law.

Benbrika was arrested and convicted over plots to attack Melbourne landmarks in 2005, including the AFL grand final at the MCG.

The self-proclaimed Islamic cleric had also called on his followers to kill at least 1000 non-believers to force the Australian government to withdraw troops from Iraq and Afghanistan.

His 15-year sentence was due to end in 2020 but the government was successful in obtaining a continuing detention order, with a court ruling he posed an unacceptable risk to the community.

The order extended his detention until this month.

In addition to plots to blow up Melbourne landmarks he also plotted to target Sydney’s Lucas Heights nuclear reactor, and was discussing assassinating then-Prime Minister John Howard….

‘Death to pederasts’: two gay men attacked with a knife in Dijon

Translated from “‘Mort aux pĂ©dĂ©rastes’ : deux hommes gays agressĂ©s au couteau Ă  Dijon,”
by Nicholas Scheffer, TĂŞtu, May 17, 2023:

Two gay men were stabbed by a man near Lake Kir in Dijon. Yannick and Benjamin recount this traumatic evening.

It is around 10 p.m., Friday May 12, when Yannick and Benjamin, two gay friends, leave a restaurant in Dijon, in Burgundy, and decide to take a walk near Lake Kir. There, they come across a man, hooded, who stabs them several times while shouting “death to pederasts.” Seven days of total work interruption (ITT) were attributed to the victims, and a complaint was filed on Sunday.

“Since we are not in a relationship, we were not walking hand in hand or anything that could challenge a homophobe,” testifies on the telephone Yannick, 39, Parisian of Dijon origin, who was mayor in Seine-Saint-Denis. According to his story, the attack near Lake Kir – which is also a place of cruising – occurs when, seized with a pressing desire, Benjamin goes towards a bush. “I’m waiting for him, a little behind, when a guy from the shadows appears, who was obviously already present,” says Yannick. The man asks the walkers what they are doing here, before approaching Benjamin, to whom he says: “Get ready, it’s your sentence.”

“My attacker pulled out a folding knife which he unfolded in front of me saying ‘it’s not over.'”

“I felt a blow, like a punch in the left buttock. With the pain I stepped back, and as I stepped back, another person came out of nowhere. My attacker was still facing me, he took out a folding knife which he unfolded in front of me saying ‘it’s not over,'” Benjamin said in his complaint, which we were able to consult. Seeing the knife, whose blade he estimates at about twenty centimeters, Benjamin puts his hand on his buttocks, bleeding, and notices that his pants are torn. “He yells at me to run, that we have to run away,” recalls Yannick.

“Death to Pederasts”

Pederasty - sexual activity involving a man and a boy or youth

As they flee, the two men separate. When Yannick turns around, he sees that the attacker is behind him. “He shouts at me ‘death to the pederasts!’ and I feel like a punch. Then he left as quickly as he appeared,” says Yannick, who notices shortly after that he has three wounds around his buttocks. Police and firefighters arrive quickly and take the two men to hospital, where doctors prescribe seven days of total sick leave each.

“We think that the aggressor is between 16 and 19 years old maximum,” testifies Yannick, who cannot describe the hooded man any further. “He was of North African type, male with short black hair, but curly on top. He was young, of normal build, dressed all in black with a hoodie,” reads the statement. Benjamin’s complaint.

If the two men are gradually recovering from their attack, the shock persists. “We don’t understand what happened, it was completely gratuitous. Even though I thought of my hometown as very calm, it had to happen there,” laments Yannick. In its latest report, SOS homophobia warns against the sharp increase in LGBTphobic attacks, 68% of which target gay men.

Were the attackers acting out of obedience to the Quran, or were they acting out of revenge for some former rape?

Ahmad killed Inger, 78 – now he can get Swedish citizenship

translated from “Ahmad slog ihjäl Inger, 78 – nu kan han fĂĄ svenskt medborgarskap,”
Fria Tider, May 14, 2023:

DOMESTIC.
In 2010, Ahmad Akileh, then 23 years old, beat 78-year-old Inger to death in Landskrona after her husband honked at him as he tried to squeeze into a parking space.
Now the government can grant Ahmad Akileh Swedish citizenship.

Akileh first beat the husband and then hit the elderly lady on the head until she died of her injuries. He was convicted of causing the death of another and received two years in prison as punishment.

Two years!!!??? He should have gotten more than 2 years for beating the husband, and life for killing his wife. But Germany is so hypersensitive about Muslims, they leave Germans in great danger. It's madness!

The issue of deportation was not addressed by the court, and after Ahmad Akileh was set free, SD leader Jimmie Ă…kesson condemned the lax Swedish justice system.

“That the sentence that Akileh was awarded for the fatal beating of 78-year-old Inger was ridiculously low, I think was bad enough. The news that this perpetrator of violence is now also to be released and also with special police protection, which most crime victims and threatened witnesses can only dream of, has really shaken me.

This case shines a light on how bad things are with the Swedish justice system today. Sweden must as soon as possible get a new legislation and a new practice that respects the victims of crime, protects the law-abiding citizens and is in harmony with the general legal opinion,” said Jimmie Ă…kesson at the time.

However, that was not the case. And 13 years after Inger’s death, Akileh has plans to become a Swedish citizen. Something that ironically seems to be granted under an Ă…kesson-supported government.

The now 36-year-old Akileh previously ran into trouble with his application to become a citizen, which Expressen’s lead writer Sofie Löwenmark was the first to notice.

However, the problems were not due to Akileh killing a Swedish pensioner, which of course does not cause any problems for those who want to become a Swedish citizen, but to the fact that a few years ago he changed his birth information at the Tax Agency, which he had previously cheated with.

He has therefore only had credit for the period he has lived here with correct identity information. But the Migration Court has granted him leave to appeal, and now he can get citizenship if he’s lucky.

He sounds pretty lucky, so far.

“The very fact that the citizenship issue is about just waiting out the time, especially after a known case of identity fraud, shows how low the requirements are. A reasonable starting point should of course be that a person who commits a murder is disqualified,” writes Expressen’s Sofie Löwenmark in her editorial.

At the Averroès high school in Lille, Salafist readings

and small arrangements between friends

Translated from “Au lycĂ©e Averroès de Lille, lectures salafistes et petits arrangements entre amis,”
by Paul Sugy, Le Figaro, May 16, 2023

INFO LE FIGARO – The regional chamber of accounts points to irregularities in the management of the Muslim high school. Above all, a course in Muslim ethics with Salafist content raises concerns.

The first private Muslim high school under contract continues to make headlines. At the beginning of May, those responsible for the neighboring Villeneuve-d’Ascq mosque were placed in police custody, in particular because of a fraudulent loan granted by the Islamic center to the Averroès high school. Their lawyer told Le Figaro that the loan, part of which was never repaid, was aimed at bailing out the high school coffers thanks to donations from the faithful. The cash flow of the latter, according to Me Mehdi Ziatt, was affected by the refusal of the Hauts-de-France region to pay in 2020 its annual subsidy to the high school (subsidy finally paid following a decision of the Council of State)….

And even if the educational project soberly refers to “universal Muslim values,” Averroès’ commitment to republican values is unquestionable – but unfortunately only on paper. The school repeatedly emphasizes its attachment to “republican values,” “education for citizenship” and “civic spirit,” which are mentioned again and again in its texts. In November 2020, the school had extensively reported on a tribute paid by the students to Samuel Paty…

However, the regional audit chamber underlines the discrepancy between this striking rhetoric and the reality of religious education at the Collège and LycĂ©e Averroès. This concerns in particular the curriculum and the reading offered as part of a voluntary course on Muslim ethics….

One of the books covered in the second grade has called out prosecutors in particular… The book contains a number of political and social rules that the believer must abide by, such as the prohibition of mixed teams in the workplace or the prohibition for a sick woman to be examined by a man. Finally, the book, which calls for referring to “the law of Allah and nothing else” in all disputes, condemns apostasy, which is presented as a crime worthy of death: Whoever ceases to be a Muslim “must be executed according to the legal punishment provided for apostasy”

Whoever ceases to be a Muslim

“must be executed according to the legal punishment provided for apostasy”

Almost every year, the LycĂ©e Averroès is nearing the 100% pass rate at the baccalaureate… Averroès has to rely, unreasonably, on the generosity of its private donors, who either donate directly or grant interest-free loans, sometimes followed by a debt waiver. In total, these donations amount to around 6 million euros over the ten years of the financial year, a large part of which comes from abroad, via funding from Qatar (which the journalist for Le Figaro Georges Malbrunot in particular has highlighted in his book Qatar Papers 2019), or even via money collected from mosques in Germany and the Netherlands. The institution also depends on public subsidies, which have amounted to more than 6.5 million euros since 2010. Public funds and private donations each account for more than a quarter of Averroès’ income, whose turnover is far from sufficient to ensure the institution’s self-financing. This business model “therefore appears structurally unbalanced and unsustainable in the long term” for the prosecutors….

The audit of Averroès’ accounts also revealed numerous errors or irregularities which, taken together, gave the impression of sometimes careless management of the association’s funds….

Salafism, and anything to do with Salafism, should be completely outlawed everywhere.

Now also in Linz, Austria: More Muslim than Catholic students

Translated from “Jetzt auch in Linz: Mehr muslimische als katholische SchĂĽler,”
Exxpress, May 20, 2023

In Vienna, Muslim schoolchildren have been in the majority for a number of years – now it’s the same in Linz. For the first time this year, more Muslims than Catholics were counted at compulsory schools in the Upper Austrian capital.

As early as 2017, more Muslim than Roman Catholic schoolchildren were counted in Vienna – this is now also the case in Linz. 12,952 students attend general compulsory schools in the Upper Austrian capital, 35.75 percent of these children – i.e. 4631 students – belong to the Islamic faith community, reports the “Kurier.” The number of students with Roman Catholic faith, however, is 33.13 percent (4291 students).

As the results of the Upper Austrian Education Directorate also show, there has also been a significant increase in students without a confession. While the number was 1,158 five years ago, it has now risen to 1,821 students – an increase of 57.2 percent.

Students of Protestant (315) and Orthodox (790) faiths, as well as other religious communities (1114), are clearly in the minority.

The diabolical destruction of Biblical sites in Judea and Samaria

‘Our history is being erased’ – Knesset Members call on the Israeli government to take action and protect archeological sites in Judea and Samaria from Palestinian destruction.

By Aryeh Savir, TPS

The Knesset’s Education Committee held a session Monday on the damage and destruction of heritage and archeology sites in Judea and Samaria, during which Members of Knesset called on the government to formulate a plan for the preservation of archeology sites in Judea and Samaria.

Grave robbers and antiquities thieves from the Palestinian Authority (PA) carry out illegal digs and excavations. The phenomenon of antiquity destruction is pervasive and affects all sites that are not under preservation, and a survey of the sites in Judea and Samaria shows that a staggering 95% of the archeological sites have been robbed, vandalized or disturbed.

Findings presented during the session by a coalition of organizations working for the protection of Israeli antiquities show that 90% of the sites that are destroyed are being destroyed by the PA for development purposes, and 10% are destroyed for robbery purposes.

Most recently, unknown individuals from the PA have again caused damage to the Biblical-era site of Yehoshua ben Nun’s Altar on Mount Ebal.

Joshua, son of Nun.

In November 2020, the PA inaugurated a “Palestinian” tourist complex in the town of Sebastia in Samaria, the historic capital of the biblical Kingdom of Israel.

Sebastia was named by Herod. Previously it was called the city of Samaria, once capitol of the northern kingdom.

Moshe Guttman, chairman of “Shomrim Al Hanetzach” (Preserving Eternity), a watchdog group dedicated to protecting Israel’s archaeological treasures, warned the Committee that “our history is being erased. We think the State of Israel is sleeping while standing up and no one is doing anything about it.”

Hanania Hizmi, Archeology Chief of Staff at the IDF’s Coordinator of Government Activities in the Territories (COGAT), claimed that the data presented to the committee on the destruction of heritage sites is incorrect.

However, he said that he has “eight inspectors at our disposal and it is difficult to monitor all the sites in such a wide area. Our inspectors have investigative and detention powers. We think we need 20 more people so that we can do serious work.”

‘There is no Palestinian people’

Amir Ganor, director of a robbery unit at the Israel Antiquities Authority, said the IAA “does not make any political distinction and every culture for us is a whole world. The situation is shocking – in Judea and Samaria, in almost every cave we entered we found a looting excavation. We work almost every night to thwart the actions of antiquities robbers.”

“If the sovereign tells us to deal with the destruction of antiquities and the robbery of sites in Judea and Samaria, we will do it with great joy and success, because we are the professional body that knows how to deal with these things,” he stated.

Hanan Erlich of the Ministry of Justice reported that his office has commenced with actions to contend with the phenomenon.

During the debate, the Jewish and Arab MKs waged a battle of words, with Arab MK Sami Abu Shehadeh claiming that “there is an erasure of the Palestinian people with a wave of the hand by a group of petty racists,” and MK Orit Strook responding “there is no ‘Palestinian people’ and that is why you are erasing the history of the Jewish people.”

Acting Chairman of the Committee, MK Moshe Tor-Paz said the committee wants to conduct an archeological survey of all the sites, “regardless of religion and heritage.”

“The committee takes seriously the state of antiquities in Judea and Samaria and seeks to compare the treatment of antiquities in Judea and Samaria with the practice of antiquities within the Green Line. The committee wants to conduct an archeological survey of all the sites, regardless of religion and heritage, and offer a plan for their preservation,” he stated.

The committee requests the establishment of the “Judea and Samaria District” in the IAA, similar to the existing model in the Nature and Parks Authority.

Murderer of Israeli mother of six says terror is a legitimate form of resistance.

By Lauren Marcus, World Israel News

The Palestinian terrorist who brutally murdered Israeli mother of six Esther Horgan in December 2020 challenged her family’s calls for him to be harshly punished in an Israeli military court on Wednesday. He characterized the slaying as an act of resistance that he was entitled to carry out.

During the sentence hearing, Horgan’s family said they would like to see Muhammad Kabha given a life sentence for the killing and an order to pay compensatory damages. Odelia Horgan, the victim’s daughter, spoke out about how the murder had affected the family.

“Since she’s been gone, our lives have been turned upside down,” Arutz Sheva reported her as saying. “Shock, our world has been shaken. The pain grows every day. How could such a human being perish from such a cruel act, disappear from the face of the earth?”

“Esther’s murder is personal to our family, to our community, and to all of Am Yisrael (the Jewish people),” Benjamin Horgan, the victim’s husband, told the court.

He said the Palestinian Authority was largely responsible for Kabha’s actions, citing their “encouragement of terrorism.” Horgan said it was “unfortunate” that Kabha was the only person being held to account for the killing, saying that “this murder was ordered” by the PA.

According to the killer’s confession, he was inspired to go out and avenge the death of his friend who died in an Israeli prison,” Horgan said.

He explained that while that prisoner’s death had occurred naturally, it was presented to the public by the PA as an “execution [of a Palestinian by Israel], in [the style of] a blood libel, and it pushed [Kabha] to take revenge.”

By whipping up excitement via false narratives about alleged Israeli abuses of Palestinians, Horgan said, the PA has created an atmosphere which led to murder and should consequently be held responsible.

Referencing the PA’s pay-for-slay policies, Horgan said that Israel could no longer “lend a hand” to an institution that rewards the murder of Jews with funding.

“If we do not take a stand today, we will….[in the future] need to discuss the case of another terrorist who caused another family in Israel to be bereaved,” he added, calling upon Prime Minister Naftali Bennett and other senior figures in the Israeli government to hold the PA accountable for both incitement and pay-for-slay.

Kabha, however, challenged the Horgan family’s assessment of events, saying that he had not been motivated by the PA.

“The family is saying that we’re dealing with incitement by the PA, but this is not incitement and not terror,” he said. “We’re talking about our right [to resist].”

He said he hopes that one day there will be peace, with no more killing on either side of the conflict.

Kabha’s absurd “pro-peace” remarks came some 13 months after he ambushed the French-born Israeli woman as she walked in the Reihan Forest near Tel Menashe in Samaria, overpowering her and repeatedly beating her in the head with rocks until she died.

The religion of peace strikes again!

Islamic State terrorists surrender to Kurds at captured, child-filled prison

The Kurdish-led Syrian Democratic Forces (SDF) took full control

The Kurdish-led SDF have beaten off Islamic State terrorists at the al-Sina’a prison in the northeastern Syrian city of Hasaka.

In a tweet on Wednesday, spokesman Farhad Shami confirmed the victory, stating that all IS militants had surrendered just hours after 500 handed themselves over following earlier clashes.

“Game Over Daesh,” he wrote in a subsequent tweet.

Shami shared photos from the prison in the aftermath of the battle.

His tweets made no reference to the 850 children and minors the UN children’s agency believes to have been caught in clashes at the prison complex.

UNICEF has registered its concern for the fate of the children who had been living alongside some 5,000 prisoners since it was seized by militants last Thursday.

“Every day counts. It’s very hard to even imagine what atrocities these children are witnessing,” UNICEF’s Middle East and North Africa regional advocacy and communications head, Juliette Touma, said on Tuesday.

The children, who had reportedly been detained for suspected links to IS during the US-backed campaign in 2019, were being held in a dormitory at the facility. The SDF said IS militants had been holed up in the building.

The Kurdish-led forces claimed the children were being used as a “human shield.”

If that were all they were used for, I would be very happy.

Sina’a prison is the largest facility operated by the SDF.

UK govt loses case against alleged ISIS member

The Court of Appeal has ruled that it’s unlawful for the UK to remove

a person's British nationality without prior notice

The UK government has lost its latest legal bid to strip a woman of her British citizenship for allegedly deciding to join Islamic State in Syria, after the Court of Appeal agreed she must be given prior notice before its removal.

The woman, who has only been identified as ‘D4’, is thought to be currently detained within the same Syrian camp as Shamima Begum, who was stripped of her British citizenship in 2019 and told she will never be allowed to return to the UK.

In its ruling, the Court of Appeal stated that, while there may be “good policy reasons” to give the home secretary the power to strip people of citizenship without notice, it is currently “not lawful.”

As such, the judge upheld an earlier High Court ruling that the attempt to strip D4 of her citizenship was “void and of no effect” because she was not notified and was unaware it had happened for 10 months.

The UK government is currently seeking to pass legislation through parliament that would give the home secretary the legal authority to deprive people of citizenship without notice. If passed, she would be able to do so in cases where it would “not be reasonably practicable” or “in the interests of the relationship between the UK and another country.”

Alleged IS members are believed to make up the majority of the 150 individuals whose British citizenship was revoked since 2014 under legislation that allows removal when it is “conducive to the public good.” However, the figures available only cover up to the end of 2019, as the government hasn’t published an annual report on the matter in two years.

An analysis by Free Movement, a group that seeks to provide information to individuals affected by immigration control, believes that, at least, 464 people have lost their British citizenship over the past 15 years. Since 2006, 175 lost their nationality on national security grounds, while 289 saw it stripped away for fraud.

U.S. Revokes Citizenship of Portland Mosque’s Imam

Mohamed Sheikh Abdirahman Kariye, the former imam of Portland’s largest mosque, arrived in Somaliland this weekend, and the United States has revoked his citizenship. The government had arranged for Kariye, who is on the government’s ‘no fly list,’’ to travel back to his homeland after reaching a settlement agreement with him in January.

The U.S. government has revoked the U.S. citizenship of the former imam of Portland’s largest mosque after he arrived in Somaliland last week.

Mohamed Sheikh Abdirahman Kariye is on the government’s no-fly list, but the government arranged for him to travel back to his homeland after reaching a settlement with Kariye in January.

Under the deal, Kariye agreed not to challenge an order revoking his citizenship and acknowledged having provided false information to immigration officials in July 1997 when he had applied for U.S. naturalization.

The settlement appeared to be briefly in jeopardy Monday morning, when Kariye’s lawyers asked to rescind it after learning that Kariye had been detained during a stopover at the Dubai airport.

Kariye, 57, boarded a flight last Wednesday from Seattle for a 14-hour flight to Dubai and a planned flight four days later to Somaliland.

He arrived in Dubai as scheduled, according to court records, but soon sent his Oregon-based lawyers a text from the airport that read, “some thing is wrong.’’

Kariye was detained and interrogated for seven hours in the Dubai airport by United Arab Emirates officials and questioned about the “Portland Seven,’’ the As-Saber Mosque in Southwest Portland and others who may have attended services there, according to his lawyers. He wasn’t allowed to contact his attorneys during the questioning and all his personal belongings were seized, according to his lawyers, Philip Smith and Nicole Nelson.

In October, federal government lawyers told a federal appeals court that Kariye was placed on the no-fly list based on his history as a "mujahedeen fighter in Afghanistan against the Russians,'' as well as his expressed support for "violent jihad'' in conversations recorded between a cooperating informant and two members of the Portland Seven. They were a group of American Muslims from the Portland area who were prosecuted and convicted of trying to join al-Qaida forces in their fight against the United States military and coalition forces in Afghanistan.

The U.S. sought to strip Kariye of his U.S. citizenship because he "provided false information and both willfully misrepresented and concealed material facts’' when applying for naturalization to the United States.

During the process, the FBI informed U.S. Justice Department attorneys that Kariye had coordinated with Osama bin Laden and other known terrorist leaders and was associated with terrorist organizations including Makhtab Al-Khidamat, or MAK, a designated terrorist organization and pre-cursor to al-Qaida.

"The parties agreed denaturalization was appropriate, following which Kariye agreed to depart the United States,'' said Kevin Sonoff, a spokesman for the U.S. Attorney’s Office and the U.S. Department of Justice.

Kariye ultimately was able to fly to Hargeisa, Somaliland. He arrived last Friday.

His lawyers alleged the questioning in Dubai amounted to a “breach’’ by the government.

"It is inconceivable that UAE officials would have interrogated Defendant about the Portland Seven and activities at the As-Saber Mosque in Portland without having received information directly from'' the government, Smith wrote to the court.

Kariye’s lawyers urged the court either to compel the government to explain why Kariye was detained Dubai or allow him to renounce his U.S. citizenship, instead of having it revoked, and withdraw his admission that he had lied previously to U.S. immigration officials when he obtained his naturalization certificate.

In a brief hearing before U.S. District Judge Robert E. Jones, attorney Christopher W. Hollis of the U.S. Department of Justice said by phone that he had no communication with the United Arab Emirates about Kariye.

Kariye’s lawyer said Hollis could have been kept in the dark, but the U.S. government still could have communicated with the United Arab Emirates about their client. Smith noted that the government had three months of advance notice of Kariye’s scheduled flight and itinerary.

"Plaintiff had a responsibility to not simply be silent but to inform the UAE that he is coming through and it is OK for him to fly,'' Smith argued.

Jones denied Kariye’s motion. The judge ordered the settlement to stand and signed an order revoking Kariye’s U.S. citizenship.

The judge said it was "unfortunate'' that Kariye was interrogated in Dubai, but that didn’t negate the settlement agreement. Jones said it appeared that the United Arab Emirates’ interrogation of Kariye was "done unilaterally'' and that the "U.S. government played no role.''

When Kariye had first sought citizenship, he had lied on his application to federal immigration officials about not being arrested in the past, failing to acknowledge a 1993 arrest in Pakistan, according to court documents.

Under the settlement, Kariye is forever prevented from claiming any rights or benefits under any document that shows he had obtained U.S. citizenship on Aug. 14, 1998.

He’s also been ordered to complete a form abandoning any lawful resident status in the United States and must send his U.S. passport by DHL Express to the government lawyer, no later than five days after his arrival in Somaliland.

The revocation of Kariye’s U.S. citizenship falls at the start of the Muslim holy month of Ramadan. Calls to the Islamic Center of Portland were not returned on Monday.
