The Court of Appeal in The Hague has dismissed Milieudefensie’s claims against Shell. According to the court, the company does have a “duty of care” to combat dangerous climate change, but Shell cannot be forced to set specific percentages by which it must reduce CO2 emissions. The appeals court thereby annulled the initial ruling.

In their ruling, the judges explain that various reports discussed during the case provided “insufficient support” to impose a specific percentage on Shell. The court also does not believe that a reduction obligation for Shell would have a positive effect on combating climate change worldwide. If Shell were to resell less oil and gas extracted by other companies, other companies could fill that gap.

Milieudefensie and other organizations had demanded that Shell reduce the CO2 emissions that it causes directly and indirectly by at least 45 percent by 2030. The plaintiffs based that percentage on scientific reports on the global emission reductions needed to still have a reasonable chance of limiting global warming to 1.5 degrees.

However, such a general standard is “not fine-meshed enough to be directly applicable to Shell,” the court ruled. According to the judges, different reduction percentages may be needed per country and per sector.

In the introduction to the ruling, the court pointed out the dangers of climate change and the responsibility of countries to reduce greenhouse gas emissions that cause global warming. This is a human rights issue for which companies like Shell also bear responsibility, the court said.

“Shell has a duty of care to limit CO2 emissions and thus counter dangerous climate change,” the court ruled. However, the court can’t force a company to do this in a certain way.

The court also agreed with the oil and gas company that the carbon intensity of different fossil fuels varies. For example, coal is more polluting than natural gas. If Shell were to supply gas to a company that previously used coal, this would lead to a decrease in total CO2 emissions, while the emissions that can indirectly be attributed to Shell would increase, the court said.

Milieudefensie director Donald Pols called the appeals court’s ruling painful, but the environmental organization is still proud of what it achieved. This lawsuit showed that “major polluters are not immune,” Pols said. Milieudefensie has thus fueled the debate about companies’ responsibility. “That is why we will continue to tackle major polluters like Shell.”

Shell is pleased with the ruling. “We are satisfied with the court’s ruling. We believe it is the right one for the global energy transition, for the Netherlands, and for our company,” said CEO Wael Sawan. He reiterated that Shell continues to strive to reduce its greenhouse gas emissions to zero by 2050.

“As Shell has previously indicated, a court ruling will not reduce overall customer demand for products like gasoline and diesel for cars, or for gas to heat and power homes and businesses. It will do little to reduce emissions as customers will simply switch to another supplier,” the company wrote.

This year, wolves have already attacked many more sheep and other animals than in the whole of 2023. In the first nine months of 2024, 491 wolf attacks on animals were registered, compared to 399 in the whole of last year. This is evident from an analysis by ANP based on data from BIJ12, the organization that handles wolf cases for the provinces.

Most attacks took place in the northeastern provinces, especially in Gelderland. The wolf struck there 237 times in the first three quarters of this year, more than twice as often as in the whole of 2023.

The number of wolf attacks is decreasing in Noord-Brabant. In 2020, wolves struck at least 50 times, last year there were only 22. This year, the counter is at 12, with five more reports where it is not known whether the attack was committed by a wolf.

Livestock farmers who suffer damage from wolf attacks can receive compensation. So far this year, the provinces have paid out almost 400,000 euros in compensation to farmers, almost as much as in the whole of 2023.

In almost all cases, the landowners had not taken sufficient preventive measures to prevent damage by wolves, according to data from BIJ12. The fact that wolves are attacking more often is because more wolves are living in the Netherlands. Five years ago, the Netherlands had one wolf pack. Now there are eleven.

The actual number of attacks may be higher. Reporting an attack to BIJ12 is not mandatory. Moreover, the organization only counted attacks where it was certain that the damage was caused by a wolf. In at least 166 cases in recent months, it could not be established whether a wolf was behind the attack

Boeing reaches settlement to avert civil trial over 2019 MAX crash

Boeing reached a last-minute settlement with the family of a 737 MAX crash victim, averting a federal civil trial set for Tuesday in Chicago. The Ethiopian Airlines crash in 2019 killed 157 people. The court will meet Tuesday to inform Judge Jorge Alonso, who must approve the settlement.



Beleaguered aviation giant Boeing reached a last-minute settlement Monday with the family of a woman killed in the crash of a 737 MAX jetliner in 2019, averting a federal civil trial.

Three sources close to the case told AFP that a settlement had been agreed upon out of court, but they gave no details.

The crash of the Ethiopian Airlines plane killed 157 people. The trial was set to begin Tuesday in Chicago.

It originally involved six plaintiffs but until now all but one had settled, according to a source familiar with the case.

The hearing on Tuesday will take place to inform Judge Jorge Alonso of the settlement, who must approve the deal for it to be officially settled, the source said.

"It is a damage-only trial, meaning no evidence regarding the liability of Boeing will be presented," the source told AFP.

The remaining case involved Manisha Nukavarapu, an Indian-born woman who was on board Ethiopian Airlines flight ET302 on March 10, 2019, when the Boeing 737 MAX 8 crashed minutes after taking off from Addis Ababa, killing all 157 people on board.

Lawyers for the plaintiff's family did not respond to a request for comment by AFP.

The initial complaint, obtained by AFP, said Nukavarapu was in her second year of medical school residency at East Tennessee State University, where she planned to become an endocrinologist.

She had planned to take the Ethiopian Airlines flight to visit her sister in Kenya.

Negligence 

A court document from June 2023 said that relatives of 115 victims filed civil complaints against Boeing for wrongful death and negligence, among other things, between April 2019 and March 2021.

As of October 22, there were still "30 cases pending on behalf of 29 decedents" according to a source close to the legal proceedings.

The complaints have been divided into several groups, with the next group scheduled to go to trial on April 7, 2025.

Boeing has "accepted responsibility for the MAX crashes publicly and in civil litigation because the design of the MCAS...contributed to these events," a lawyer for Boeing said during an October hearing.

MCAS, a flight stabilizing feature, was implicated in the Ethiopian Airlines crash and a 737 MAX 8 jet operated by Lion Air, which crashed on October 29, 2018, about 10 minutes after taking off from Jakarta, Indonesia. All 189 people aboard the plane died.

After the two 737 MAX crashes, the entire 737 MAX fleet were grounded for more than 20 months for authorities to conduct an investigation.

According to Boeing, more than 90% of the civil complaints filed about the two crashes have been resolved.

"Boeing has paid billions of dollars to the crash families and their lawyers in connection with civil litigation," an attorney for Boeing, Mark Filip, said at a hearing on October 11.

The police arrested three people after another night of unrest in Amsterdam, this time in the Nieuw-West district. The riot police intervened and calm had mostly returned by the end of the evening, the Amsterdam police reported on X.

The unrest started at around 7:15 p.m. on Plein ‘40-’45. A group involving dozens of people, many on scooters and fat bikes, committed vandalism, threw fireworks, and pelted cars and a bus with stones, local media wrote.

A tram caught fire after a firework was thrown into it. No one was on the tram at the time and first responders quickly extinguished the blaze.

At around 10:15 p.m., the square was accessible again because the rioters had moved on to Slotermeerlaan. There, they pelted police officers with stones, AT5 reported.

The police reported no injuries that required hospitalization. One of the rioters got hurt while setting off a firework. Paramedics treated them at the scene.

Parool reported that a boy on a bicycle got beaten up when cycling past the group. “People are agitated. The police really saved me,” he told the newspaper.

The police expect more arrests to follow. There is plenty of video footage with which investigators can identify perpetrators, a police spokesperson told NOS. Anti-Semitic insults can be heard in the videos.

Things have been restless in Amsterdam since a match between Ajax and Maccabi Tel Aviv on Thursday. Riots followed the match and Maccabi supporters were chased and attacked in several places. There is also footage of Israelis instigating violence against locals. Earlier, Maccabi supporters had pulled down Palestinian flags and vandalized taxis. On Sunday, the police arrested over 50 people at a banned pro-Palestine demonstration on Dam Square.

An emergency decree is in effect in Amsterdam until Thursday. The decree bans all demonstrations and the wearing of face-covering clothing. It also gives the police more power to take preventative action, like stopping and frisking people




Amsterdam trams & buses will not run in Nieuw-West

tonight amid calls for more rioting


Amsterdam public transport firm GVB announced adjustments to scheduled service after an area police commander warned that more rioting could take place in the Nieuw-West district on Tuesday night. The company said three of its tram routes and two bus lines will run a modified route, while one tram and two bus lines will not run at all after rioters a night earlier smashed one of the GVB trams, and detonated fireworks inside of it.

The tram caught on fire at Plein '40-'45 during the continuation of violence in the Dutch capital that has been ongoing since last week. Anti-Semitic slurs could be heard on videos while the fireworks were lit. Last Thursday, football supporters and hooligans aligned with Israeli team Maccabi Tel Aviv were stalked, chased, and attacked throughout the city after the club played a Europa League match against Ajax.

Due to more "expected unrest," the GVB said it was implementing a series of changes at least until 1 a.m. on Wednesday Tram 13 will not run at all during that time. The tram normally connects Amsterdam's Central Station and the Lambertus Zijlplein in Geuzenveld with stops in the city center, and the West and Nieuw-West districts. Bus lines 61 and 63 also will not run their routes, which mainly serve the Nieuw-West district.

Trams 1, 7 and 17 will also run shorter routes. Tram 1 will carry riders between Muiderpoortstation and Surinameplein, line 7 will shuttle between Azartplein and the Postjesweg/Hoofdweg stop, and Tram 17 will operate between Central Station and Bos en Lommerplein. Bus 21 will also operate between Central Station and Bos en Lommerplein, while bus 369 will only operate between Sloterdijk Station and Anderlechtlaan.

In any case, tram 7, bus 21 and bus 369 will not stop at Plein '40-'45, the site of violence on Monday night. Tram 7 and 13 also would normally stop at Mercatorplein, but those stops have been scrapped. That stop has been the site of violence in the past. It was not immediately clear if that was the reason that the GVB was not using buses 15 and 18 at that location, like normal.

Earlier on Tuesday, Amsterdam police team leader Olivier Dutilh testified in court that there were no signals that violence could again break out on Tuesday night. "There is a call, 'Women and children stay at home," he said about messages intercepted by police. "That worries us. A lot."

Does that make any sense to any of you? What am I missing here?

Harsh messages distributed on social media just before the Ajax-Maccabi football match were also seen as a way to rally people together to violently pursue Maccabi supporters, with an apparent focus on those who were Israeli or Jewish. A debate on the violence started in City Council at noon on Tuesday, and will also be addressed in Parliament on Wednesday.

Guilbeault accused of siphoning $254 million to his own company

On Friday, Kusie (Calgary Midnapore) said Guilbeault invested $254 million into a company he owns.

“This government is failing to comply with parliament and hand over the documents pertaining to this potentially corrupt activity,” said Kusie in a social media post.

“Canadians deserve answers and accountability from this scandal plagued Liberal government. When will they hand the documents over to the RCMP?”

Last week, the National Post reported that auditor General Karen Hogan struck down a House of Commons committee request for another audit of the green slush fund, saying it likely wouldn’t reveal anything new.

In a letter to the public accounts committee in October, Hogan said her office would not conduct the “value for money and performance audit” of Sustainable Development Technology (SDTC) requested by the committee last month, reported the National Post.

Conservative MPs continue to call for the release of green slush fund documents. 

“After nine years, this NDP-Liberal government is just not worth the cost,” said Kusie in the House on Friday.

“The environment minister invested $254 million in a company that he owns. The government continues to hide the documents. The green (slush) fund is against the interests of this house.”

Liberal MP Karina Gould (Burlington) responded to Kusie, accusing her of dishonesty. She said the federal government has already tabled all the documents requested by the House. 

“We did so in a way that respects the Canadian Charter of Rights and Freedoms,” said Gould. “The Conservative Party is blocking its own blocking of this house's work. On this side of the house, we respect democracy. We respect the rights of Canadians and we respect the authority of the police.”

But, quite obviously you don't respect the truth, and you have no fear of God.

RCMP Commissioner Mike Duheme is concerned that some of the green slush fund documents sent to police through a House order are outside “the normal reach of investigators, putting the force in an awkward legal grey zone,” reported the National Post.

Allegations against Guilbeault have not been proven in court.

Russia denies Trump, Putin spoke

The Kremlin dismissed on Monday reports that U.S. President-elect Donald Trump had spoken to Russian President Vladimir Putin in recent days as “pure fiction.”

A source told Reuters on Sunday that Trump, who has criticized the scale of U.S. military and financial support for Kyiv and said he will end the war quickly, had spoken to Putin in recent days.

The source told Reuters they were familiar with the conversation, first reported by The Washington Post, which cited unidentified sources as saying Trump had told Putin that he should not escalate the Ukraine war.

In an unusual move, Kremlin spokesman Dmitry Peskov said on Monday no such call had taken place between Putin and Trump.

“This is completely untrue. This is pure fiction, it’s just false information,” he told reporters. “There was no conversation.”

“This is the most obvious example of the quality of the information that is being published now, sometimes even in fairly reputable publications,” he said.

Asked whether Putin had plans for any contacts with Trump, Peskov said: “There are no concrete plans yet.”

Media Lies About Muslim Street Violence

While most elected officials condemned the sustained Muslim street violence campaign against Jews (and anyone they thought was Jewish or at least non-Muslim in a given part of Amsterdam), the media quickly rushed into cover-up mode, describing it as ‘soccer hooliganism’ and a ‘clash’ involving ‘fans of an Israeli soccer team’ triggered by the burning of a PLO flag.

1. Soccer or ‘football’ was not the issue. It just created Jewish targets. This was a friendly match with a local soccer team that has a lot of Jewish fans. The Muslim mobs attacking Jews were not supporting the other team.

2. It was a systemic planned attack that predated any events of that night. The perpetrators described it as a hunt for Jews.

 

Nor is it a new phenomenon. Here’s a clip of a call for hunting Jews by a Muslim mob in the UK 2021.

 

So no, this isn’t about Gaza or anything after Oct 7. It’s about Islam and the media’s willingness to cover up anything involving Islam. Especially when the targets are Jewish or Christian.

The same media that spent months covering up a Muslim terror stabbing of young girls in the UK while criminalizing anyone who spoke out against it is back in action, doing what it always does.




Confirmed: Contrary to claims, largest number of fatalities in Gaza were fighting-age men, not women and children


The entire world has lined up to demonize Israel over lies.

The international media glommed onto this propaganda and happily spread it on the front page even though it contradicts Hamas' own reports. That's how little investigation goes into looking for the truth in the news - virtually none!

Find the 5-9 age group in the graph above - for boys it's less than 400, for girls it's less than 300. For men between 25 and 35 it's about 550, and for women in that age group about 200. 

It would be nice if no children were killed, but Hamas has to be eradicated and as long as they hide themselves among women and children there are going to be unwanted casualties.

Unfortunately, Gazans don't want to, or can't seem to extricate themselves from Hamas soldiers. Hamas doesn't mind the IDF killing Palestinian civilians, it's their number one propaganda weapon. Besides, Hamas are not Palestinians, so why should they care?
